To reserve your space on the workshop, a £350 booking fee is required.

This booking fee confirms your place on the photography workshop and secures your spot in what is a small, limited group experience.

Once your payment has been received, your space is guaranteed.

The remaining balance will be invoiced six weeks prior to the start date of the workshop.

Spaces are intentionally limited to keep the experience personal, relaxed and tailored to everyone attending. I can’t wait to share the Faroe Islands with you.

Terms & Conditions

James Kelly Photography Workshops

1. Agreement to Terms

By booking or participating in any workshop, tour, or photography experience operated by James Kelly Photography (“James Kelly”, “we”, “our”, “us”), you agree to these Terms and Conditions.

If you do not agree to these Terms, you must not book or participate in the workshop.

2. Assumption of Risk & Personal Responsibility

Photography workshops in the Faroe Islands involve outdoor activity in natural and sometimes remote environments. By booking a workshop, you acknowledge and accept that:

  • Outdoor photography carries inherent risks.

  • Weather conditions may change rapidly.

  • Terrain may include uneven ground, wet rocks, cliffs, steep paths, mud, snow, ice, and coastal exposure.

  • Accessing locations may involve walking, inclines, and unpaved trails.

You confirm that:

  • You are physically and mentally fit to participate.

  • You take full responsibility for assessing your own capabilities.

  • You will exercise personal judgement at all times.

  • You will not attempt any action or position that feels unsafe to you.

Participation is entirely voluntary. You accept full responsibility for your own safety at all times.

3. Limitation of Liability

To the fullest extent permitted by UK law:

James Kelly Photography shall not be liable for:

  • Personal injury

  • Illness

  • Loss of life

  • Damage to personal property

  • Loss or theft of equipment

  • Travel delays or disruptions

  • Weather-related disruption

  • Acts of third parties

This includes incidents occurring during transport, at accommodation, or at any workshop location.

Nothing in these Terms excludes liability for death or personal injury caused by proven negligence, or any other liability which cannot legally be excluded under UK law.

4. Equipment Responsibility

You are solely responsible for:

  • All photography equipment

  • Personal belongings

  • Clothing and footwear

  • Laptops, drones, filters, tripods, and accessories

James Kelly Photography accepts no responsibility for:

  • Loss

  • Theft

  • Accidental damage

  • Weather damage

  • Water damage

  • Impact damage

You are strongly advised to hold appropriate insurance covering:

  • Travel

  • Medical emergencies

  • Equipment

  • Cancellation

Drone users must comply with all Faroese aviation and local regulations. You are solely responsible for permits, permissions, and safe operation.

5. Health & Medical

You confirm that:

  • You do not have any medical condition that would make participation unsafe.

  • You will inform James Kelly of any relevant condition prior to the workshop.

You are responsible for:

  • All medical expenses

  • Emergency evacuation costs

  • Rescue services

  • Medication

James Kelly may seek emergency medical assistance if deemed necessary. All associated costs remain your responsibility.

6. Weather & Itinerary Flexibility

The Faroe Islands are known for rapidly changing weather. Workshop itineraries are flexible and may change due to:

  • Weather conditions

  • Safety concerns

  • Road closures

  • Ferry cancellations

  • Local restrictions

No refunds or discounts will be given due to itinerary adjustments caused by factors outside of our control.

7. Cancellation by Participant

Cancellation must be made in writing.

  • More than 120 days before workshop start: Full refund minus deposit.

  • 119–60 days before: 50% refund.

  • Less than 60 days: No refund.

Deposits are non-refundable.

If your space is filled by another participant, a refund may be offered at our discretion.

8. Cancellation by James Kelly Photography

We reserve the right to cancel a workshop due to:

  • Insufficient bookings

  • Severe weather conditions

  • Government restrictions

  • Force majeure events

If cancelled by us, you will receive a full refund of payments made directly to James Kelly Photography.

We are not responsible for flights, insurance, accommodation outside of workshop arrangements, or other personal expenses.

9. Conduct

Participants must:

  • Act respectfully toward others

  • Follow reasonable safety guidance

  • Respect local communities and landowners

  • Follow Leave No Trace principles

James Kelly reserves the right to remove any participant whose behaviour compromises safety or group experience. No refund will be given in such circumstances.

10. Insurance

Comprehensive travel insurance is strongly recommended.

This should cover:

  • Trip cancellation

  • Medical emergencies

  • Evacuation

  • Equipment damage or loss

Proof of insurance may be requested.

11. Photography & Promotional Use

You retain full copyright of your images.

James Kelly Photography may photograph or film workshops for promotional purposes. By participating, you grant permission for your likeness to appear in marketing material.

If you prefer not to be included, you must notify us in writing before the workshop begins.

12. Third-Party Services

Workshops may involve third-party providers (accommodation, ferries, transport, restaurants).

James Kelly Photography is not liable for:

  • Delays

  • Service failures

  • Losses caused by third parties

13. Governing Law

These Terms are governed by the laws of Scotland, United Kingdom / Faroe Islands. Denmark.

Any disputes shall be subject to the exclusive jurisdiction of the Scottish, UK, Faroese and Danish courts.

14. Acceptance

Payment of deposit confirms acceptance of these Terms and Conditions.
